Terms of sale
This English version is a courtesy translation provided for your convenience. In the event of any discrepancy, the French version of these terms of sale prevails.
These general terms of sale (the “Terms”) apply to all orders placed on the website https://www.mycolorsworld.com (My Color’s). Please read them carefully: by placing an order, you accept them in full.
Article 1 – Purpose and scope
These Terms govern the distance selling, by [à compléter] (the “seller”, “we”, “us”), of digital coloring pages for children to consumers, meaning individuals acting for purposes outside their trade, business, craft or profession (“you” or the “customer”).
They are available on the website at any time, are presented to you before each order and can be saved or printed. The Terms that apply are those in force on the date of your order (for the subscription, see also article 9.5). They are written in French; this English translation is provided as a courtesy, and only the French version is legally binding.
To place an order, you must be of legal age or have the permission of a parent or legal guardian.
Article 2 – Seller’s identity
- [à compléter], [à compléter]
- Address: [à compléter]
- SIRET (French business registration number): [à compléter]
- Email: colorshopworld@gmail.com
For any question, you can also use our contact form.
Article 3 – Products
All our products are digital content: PDF files in A4 format, to print at home. No physical product is sold and nothing is shipped by post. The main characteristics of each product (title, preview, number of pages, price) are shown on its product page before you order.
- Single coloring page: one coloring page, as one PDF file, for €0.99.
- Coloring book: 15 coloring pages plus a story to read, in a single PDF file, for €5.
- Mystery coloring page: a single coloring page drawn at random by the website from those you do not own yet, for €0.50 (see article 8).
- “Le Club My Color’s” subscription: a monthly subscription at €9.99 per month, which gives you 3 credits each month to exchange for coloring books of your choice (see article 9).
- Free coloring pages: some coloring pages may be offered for free. Downloading them requires a free account. The licence in article 11 also applies to these coloring pages.
Functionality and compatibility. The PDF files open with any PDF reader, on a computer, tablet or smartphone. They are designed to be printed on A4 paper with a home printer; a black and white printer is enough. They can also be printed on US Letter paper by choosing your printer’s “Fit to page” option, and opened in drawing apps that can import PDF files. Colors and print quality depend on your equipment and paper.
Article 4 – Prices
Prices are shown in euros, all taxes included. TVA non applicable, art. 293 B du CGI
The price to pay is the one shown on the website when you confirm your order. No delivery or handling fees are added. The total price of your order is shown to you before payment.
Each product is charged at the price in force at the time of the order. For the subscription, see article 9.
Article 5 – Ordering
You do not need to create an account before buying a coloring page or a book. Only the subscription requires an account. To place an order:
- you add the products of your choice to your cart;
- you check the contents of your cart and the total price, and you can change or remove products to correct any errors;
- you tick the box by which you accept these Terms, request immediate access to the digital content and acknowledge that you therefore lose your right of withdrawal (see article 10);
- you are redirected to the secure payment page of our payment provider Stripe, where you enter your email address and payment details;
- you finally confirm your order by clicking the payment button, whose wording makes it unambiguously clear that your order involves an obligation to pay (“order with obligation to pay” or similar wording, article L221-14 of the French Consumer Code).
The sale is concluded as soon as your payment is accepted. You then receive an order confirmation email, which confirms your request for immediate access to the digital content and your waiver of the right of withdrawal.
If you do not have an account yet, one is created automatically with the email address used for the order, and you receive a link to choose your password. The contract is concluded in French.
We archive your orders and the version of these Terms that applies to each of them; you can ask us for a copy at any time.
Article 6 – Payment
Payment is due immediately, when you order. It is made on Stripe’s secure payment page, by bank card, Apple Pay, Google Pay or any other payment method offered on that page.
Payment is processed directly by Stripe: your card details are never sent to us and are not stored by us. For the subscription, your payment method is saved by Stripe so that the monthly payments can be taken.
Article 7 – Supply of the digital content
Nothing is shipped by post: your coloring pages are supplied as PDF files to download, immediately after your payment is confirmed:
- on the order confirmation page, from which you can download your files;
- by email, to the address given when ordering: you receive download links, and the files as attachments when they are small enough;
- in your account, in “Ma bibliothèque” (My library), where you can download them again, within the per-file download limit set out in article 11.
The digital content is supplied as soon as it is made available to you by any of these means. If the confirmation email does not arrive, check your spam folder, log in to your library or contact us.
If any content is not supplied to you, you can ask us to supply it. If we fail to do so without undue delay after your request, or within any additional period expressly agreed between us, you may terminate the contract and get a refund, in accordance with articles L224-25-1 et seq. of the French Consumer Code.
Article 8 – Mystery coloring page
When you buy a mystery coloring page, after your payment the website automatically picks, at random, a single coloring page from the catalogue that you do not own yet. You do not choose this coloring page: it is revealed to you on the confirmation page and in the confirmation email, and added to your library.
As with any digital content supplied immediately with your consent, the coloring page you receive cannot be exchanged or refunded (see article 10). If you have a technical problem (unreadable file, a coloring page you already owned, download not working, etc.), contact us and we will find a solution together.
Article 9 – “Le Club My Color’s” subscription
9.1 Subscribing
The subscription requires a customer account. You subscribe from the Club page: after ticking the box mentioned in article 10, you pay on Stripe’s secure payment page, under the conditions of articles 5 and 6. The price of the first month is paid when you subscribe.
9.2 Term and automatic renewal
The subscription runs for a period of one month, at €9.99 per month. It is renewed automatically (tacit renewal) at the end of each period, for a new one-month period, until you cancel it. The price of each new period is charged automatically at its start, to the payment method saved with Stripe. There is no minimum commitment period.
9.3 Credits
- Each paid month adds 3 credits to your account.
- 1 credit = 1 coloring book of your choice from the catalogue. The book you choose is added to your library.
- Unused credits roll over from month to month, as long as your subscription is active.
- Unused credits are lost when your subscription ends. They have no cash value: they cannot be refunded or exchanged for money.
- Books obtained with your credits are yours to keep: they stay in your library, even after your subscription is cancelled.
9.4 Cancellation
You can cancel your subscription at any time, free of charge, without having to give a reason:
- online, in a few clicks, from your account, using the “Résilier mon abonnement” (Cancel my subscription) feature (direct access: Cancel my subscription);
- or by email, at colorshopworld@gmail.com, stating the email address of your account.
In accordance with article L215-1-1 of the French Consumer Code, we acknowledge receipt of your cancellation and confirm by email the date on which your subscription ends and the effects of the cancellation.
Cancellation takes effect at the end of the current monthly period, which has already been paid. No further payment is taken afterwards. The current month is not refunded: until it ends, your subscription remains active and you can keep using your credits. On the end date, unused credits are lost; the books you have already obtained stay in your library.
9.5 Changes to the price or conditions
The subscription price is the one shown when you subscribed. If its price or conditions were to change, we would inform you by email at least 30 days in advance; the change would only apply to monthly periods starting after that notice period. If you do not accept it, you can cancel your subscription free of charge before it applies.
9.6 Statutory provisions on tacit renewal
In accordance with article L215-4 of the French Consumer Code, the French version of these Terms reproduces in full the statutory provisions on the tacit renewal of contracts (articles L215-1, L215-2, L215-3 and L241-3 of the French Consumer Code). In short:
- for service contracts concluded for a fixed term with a tacit renewal clause, the professional must inform the consumer in writing, by dedicated letter or email sent no earlier than three months and no later than one month before the end of the period during which renewal can be refused, of the option not to renew the contract, stating the deadline for doing so in a clearly visible box;
- if this information has not been sent, the consumer may terminate the contract free of charge at any time from the renewal date, and any advance payments made after the last renewal date are refunded within thirty days of termination, minus the amounts corresponding to the performance of the contract up to that date;
- if the professional fails to make this refund, the sums due bear interest at the statutory rate.
In any event, you can cancel your Club subscription at any time, free of charge, as described in article 9.4.
Article 10 – Right of withdrawal
As a rule, a consumer buying at a distance has 14 days to withdraw from the purchase. However, under article L221-28 13° of the French Consumer Code, this right cannot be exercised for the supply of digital content not supplied on a tangible medium where performance has begun before the end of the withdrawal period, after the consumer’s prior express consent to this immediate performance and acknowledgement that they thereby lose their right of withdrawal, and where the professional has confirmed this consent.
Because our files are made available to you immediately after payment, before any payment we ask you to tick a box by which:
- you accept these Terms;
- you request immediate access to the digital content, before the end of the withdrawal period;
- you acknowledge that you therefore lose your right of withdrawal.
The order cannot be confirmed unless this box is ticked. Your consent and waiver are confirmed to you in the order confirmation email.
The same box must be ticked when you subscribe: the subscription starts as soon as you pay, as your credits are immediately available to get the coloring books of your choice.
As a result, no refund is possible after a purchase: a confirmed order cannot be cancelled, exchanged or refunded.
Exception for technical defects. If a file is technically defective (unreadable, incomplete, wrong file, download impossible), contact us: we will replace or fix it as soon as possible. This does not affect your rights under the legal guarantee of conformity (article 12).
Article 11 – Licence and intellectual property
The coloring pages are works protected by copyright. The drawings remain the exclusive property of [à compléter]. Your purchase (or the download of a free coloring page) does not transfer ownership of the drawings to you: it gives you a personal, non-exclusive and non-transferable right of use, within the following limits.
What you may do:
- print the coloring pages as many times as you like, for personal and family use;
- use them with the group of children you look after, in a single class or a single childcare setting (nursery, day nursery, holiday club, childminder, etc.), printing as many copies as needed for that group.
What is not allowed:
- reselling the files or the printed coloring pages;
- redistributing the files, for free or not, for example by passing them on to other families, colleagues or other settings;
- sharing the files online: on a website, on social networks, in shared cloud storage or in a group chat;
- any commercial reuse of the drawings, for example on products or materials that are sold.
Anti-sharing measures. To protect our work and make sure this licence is respected, we apply the following measures:
- every PDF you download is personalised: a footer shows your name or email address and your order number;
- the number of downloads is limited for each file (currently 10 downloads per file); if you reach the limit, contact us: we can grant you extra downloads;
- the download links sent by email are signed and expire after 7 days; your files remain available in your library;
- the public previews on the website are low-definition and watermarked.
If unauthorised sharing is detected, we may suspend access to the files concerned, without prejudice to any other remedies available to us.
Any unauthorised use may constitute copyright infringement. If you are unsure whether a use is allowed, write to us first.
Article 12 – Legal guarantee of conformity
We must supply digital content that is in conformity with the contract, meaning that it matches its description and can be used as announced. You therefore benefit from the legal guarantee of conformity provided for in articles L224-25-1 et seq. of the French Consumer Code, summarised below.
12.1 Duration of the guarantee
- For each file supplied (single coloring page, coloring book, mystery coloring page, book obtained with a credit), you have two years from its supply to claim under the guarantee if a lack of conformity appears. For one year from supply, you only need to establish that the defect exists, not when it appeared.
- For the subscription, which is supplied continuously, the guarantee covers any lack of conformity appearing during the whole term of the subscription; you only need to establish that the defect exists.
Where applicable, the guarantee includes our obligation to supply the updates needed to keep the content in conformity.
12.2 Your rights
You are entitled to have the content brought into conformity (for example by receiving a corrected file) without undue delay after your request, free of charge and without major inconvenience to you.
You may obtain a price reduction while keeping the content, or terminate the contract and receive a full refund in exchange for giving up the content, if:
- we refuse to bring the content into conformity;
- bringing it into conformity is unjustifiably delayed;
- it cannot be brought into conformity without costs for you;
- bringing it into conformity causes you major inconvenience;
- the lack of conformity persists despite our attempt to fix it.
You are also entitled to a price reduction or to terminate the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. In that case you do not have to ask first for the content to be brought into conformity. Where the lack of conformity is minor, the contract can only be terminated if no price was paid for it (for example for a free coloring page).
Refunds are made within 14 days of our being informed of your decision, using the same payment method as for the order, at no cost to you. If the contract is terminated, you agree to stop using the content concerned and not to make it available to third parties; we may remove it from your library.
Any period during which the content is unavailable while being brought back into conformity suspends the remaining guarantee period until the content is supplied again in conformity.
These rights derive from articles L224-25-1 to L224-25-31 of the French Consumer Code.
A professional who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to up to 10% of average annual turnover (article L242-18-1 of the French Consumer Code).
You also benefit from the legal guarantee against hidden defects provided for in articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect. This guarantee entitles you to a price reduction if you keep the content, or to a full refund in exchange for giving it up.
12.3 How to claim under the guarantee
Write to us at colorshopworld@gmail.com or through our contact form, giving the email address used for the order and describing the problem. We may ask you to cooperate, to a reasonable extent and by the least intrusive means available (for example by telling us which device, software or printer you use), so that we can check whether the problem comes from your digital environment. If you do not cooperate, you may have to prove the lack of conformity yourself.
Article 13 – Customer account
Your account gives you access to your library (“Ma bibliothèque”), where you will find all your coloring pages and books, to download again (within the limit set out in article 11), and to the management of your subscription. You can access it from the My account page.
You are responsible for keeping your password confidential. If you think someone else has access to it, change it and let us know.
You can ask us to delete your account at any time by writing to us. Deleting it ends your access to your library and, if you have an active subscription, cancels it and causes unused credits to be lost: remember to download your files first. Files already downloaded can still be used under the licence in article 11. In accordance with our privacy policy, an account that has been inactive for 3 years may also be deleted.
Article 14 – Liability
We are fully liable for the proper performance of our obligations. However, we are not liable if we prove that the failure or improper performance is attributable to you, to the unforeseeable and insurmountable act of a third party to the contract, or to force majeure (article L221-15 of the French Consumer Code).
You are responsible for having compatible equipment (a device able to open a PDF file, an internet connection and, where relevant, a printer), as described in article 3. If you have any difficulty, contact us and we will be happy to help.
Article 15 – Customer service and complaints
For any question or complaint, you can write to us:
- by email: colorshopworld@gmail.com;
- through our contact form;
- by post: [à compléter], [à compléter].
Please include the email address used for your order. We will reply as soon as possible.
Article 16 – Consumer mediation
In accordance with articles L612-1 et seq. of the French Consumer Code, you are entitled to use a consumer mediator, free of charge, to seek an amicable settlement of any dispute between you and us. We have signed up with the following mediator:
- [à compléter]
Before contacting the mediator, you must first have tried to resolve the dispute directly with us by means of a written complaint (see article 15). In particular, the mediator cannot deal with your case if your request is manifestly unfounded or abusive, if the dispute has already been examined or is being examined by another mediator or by a court, or if you refer the matter more than one year after your written complaint.
Mediation is optional: you remain free to go directly to court.
Article 17 – Personal data
The personal data collected when you order is needed to process your order, supply your files and manage your account and subscription. How it is processed and your rights are described in our privacy policy. The use of cookies is explained in our cookie policy.
Article 18 – Governing law and disputes
These Terms are governed by French law. If you live in another European Union country, you also benefit from the mandatory consumer protection rules of your country of residence.
In the event of a dispute, we invite you to contact us first to seek an amicable solution, and then, if necessary, to use mediation (article 16). Failing agreement, you may bring the matter, at your choice, before the court of the place where you lived when the contract was concluded or when the harmful event occurred, or before any other court with territorial jurisdiction under the French Code of Civil Procedure (article R631-3 of the French Consumer Code). If you live in another European Union country, you may also bring proceedings before the courts of your country of residence.
